1. About these terms

These terms are an agreement between you and JartaApps, Morlans, San Sebastián, Spain, who runs Kindoc ("we", "us"). They apply to the Kindoc apps for iPhone, iPad and Android, to the web app at https://app.kindochealth.com and to the website at https://kindochealth.com, together "Kindoc".

By creating an account, buying Pro or using Kindoc, you accept these terms. If you do not accept them, do not use Kindoc.

Kindoc is about health, so please read sections 3 to 6 in full. They say what Kindoc is not, and what to do in an emergency.

2. What Kindoc does

Kindoc lets you talk about a health question with a care team of AI characters, in your own words and your own language. Each concern is a consultation. You write what is going on, and you can add photos and PDF documents, such as a lab report. A character asks questions, explains in plain words what such a problem usually relates to, and suggests what you could do now and when, and where, to get care. When a question is another character's area, the character you are talking to brings them into the same consultation.

At the end of a consultation, Kindoc can put together a visit summary: what you told the team, what you talked about, what to do now, when to get care, signs to watch for and questions for your doctor. You can show it, share it as a PDF or print it. On iPhone, iPad and Android, a character can also check in with you on a day you choose.

For you and for the people you add, such as a child or a parent, Kindoc keeps a health record (conditions, medicines and allergies), notes the team writes about what matters, and past consultations. The team reads them to answer you.

The replies, summaries, notes and health record entries are written by AI models that other companies run for us. We cannot promise that a reply is correct, complete or right for you.

3. What Kindoc is not

  • Not a doctor, and not medical care. The care team is AI, not doctors, nurses or other health professionals. No human reads your consultations as they happen or checks the replies before you see them.
  • Not medical advice, a diagnosis or a prescription. The team gives general health information and helps you prepare for real care. It does not tell you what you have, and it does not prescribe, adjust or stop a medicine or a treatment.
  • Not a medical device. Kindoc is not meant to diagnose, treat, cure, monitor or prevent any disease or condition.
  • Not therapy or a mental health service. The team can talk about sleep, stress and energy, but Kindoc is not therapy, counselling or psychological care.
  • Not an emergency service. See section 4.
  • No examination. The team cannot see you, examine you, run tests, refer you, book an appointment or contact your doctor. It knows only what you tell it and what is in your photos and documents. It may not be able to read a scanned document, because it reads only the text stored in a PDF.

4. Emergencies

Kindoc is not for emergencies. If you or someone else may be in danger, call your local emergency number now. Do not wait for a reply, and do not use Kindoc instead of calling.

When a message describes what may be an emergency, or a crisis such as thoughts of suicide or self-harm, the team shows a help card for the country your device is set to: the emergency number, or for a crisis, a crisis line where we have one. It shows it even when you have used your messages for the day. But the team can miss an emergency, a number can change, and Kindoc may be unavailable when you need it. We cannot promise that a help card will appear, or that its number is right where you are. Nobody at JartaApps watches consultations or can send help.

5. The care team is AI

  • The characters are AI. Their names are made up, and their portraits are made with AI and show no real person.
  • They have no qualifications, licence, schooling or life story, and they never use a title such as "Dr.". If you ask, they say plainly that they are AI.
  • Each character has an area, such as skin or children's health. An area says what the character talks about, not a specialty in which anyone is trained.
  • They can sound warm and personal, and they remember what is saved in Kindoc (section 8). They are still software: they can be wrong, sound surer than they should, misread a photo or a document, or miss something important.

6. Your health decisions

Decisions about your health, and about the health of the people you ask about, are yours and theirs. Use Kindoc to understand and prepare, not to decide on your own:

  • Check with a doctor, a pharmacist or another qualified professional before you make a medical decision, start, stop or change a medicine or a treatment, or decide not to get care.
  • When to get care: the care level in a reply or a summary (now, today, within a few days, at a routine visit, or self-care) is a suggestion based only on what you told the team. If you are worried, or things get worse, get care sooner than it says.
  • Children, pregnancy and older people can get worse faster. With them, ask a professional early.
  • Medicines: the team does not give doses. Follow the package leaflet and ask a pharmacist or a doctor.

7. Privacy

Our privacy policy explains what we collect, why, who helps us run Kindoc, and what you can do about your data. It is part of these terms. Before your first consultation, Kindoc asks for your explicit consent to use your health information to answer you.

8. Your health record, notes, summaries and check-ins

  • The health record: the team can add to a person's health record from what you say or from a document you send, and change it from what you say, also when it writes a visit summary. Each change shows in the consultation or in its summary, with an Undo button. You can also add, edit and delete entries yourself, on the person's page.
  • Notes: the team can note things that matter for later, such as a habit or what helps. Each note shows with an Undo button, and you can see and delete them on the person's page.
  • Visit summaries are made by AI from the consultation. Read a summary before you show or send it: it can leave something out or get something wrong. It is not a medical record or a diagnosis.
  • Check your record. Entries the team writes can be wrong. Keep the record correct, because the team reads it in every reply.
  • Check-ins are notifications on your device, on the day you chose. They show the character's question, which can mention your symptom, on your lock screen. They are not available on the web.

9. Age, your account and the people you add

  • You must be at least 18 years old to use Kindoc or buy Pro.
  • An account is for one person. Give a real email address, keep your sign-in details safe, and do not share your account. You are responsible for what happens in it.
  • An account can be signed in on one device at a time. Signing in on a new device signs out the others.
  • With Pro, you can add other people, such as a child, a partner or a parent, and ask about them. A person you add never uses Kindoc themselves.

When you add someone, or ask about them, you promise that you may share their health information with us:

  • A child: you are their parent or legal guardian, or you have the agreement of the person who is.
  • An adult: they have agreed to it, or the law lets you act for them, for example as their legal guardian.

Share only what the question needs. If they ask you to stop, remove them and their consultations from Kindoc (Profile, then People).

10. Free and Pro

  • Free: your first consultation, with photos, documents, a visit summary and a check-in, up to a number of messages. After it, a few messages a day, without photos or documents.
  • Pro: more messages each day, photos and PDF documents in every consultation, and adding the people you care for.

Each plan has limits, and the app shows you when you reach one. Daily limits start over each day in your time zone. If Pro ends, the people you added stay in Kindoc, and you can still read and edit them.

11. Buying Pro

Plans and prices

  • Pro is sold as a weekly or a yearly subscription, or as a lifetime purchase. Not every plan is offered on every platform or in every country.
  • The price, the billing period, any free trial and any tax are shown before you confirm a purchase. Prices can differ between the App Store, Google Play and the web, and between countries.
  • A lifetime purchase is paid once. It keeps Pro on the account that bought it for as long as we offer Kindoc.

In the iPhone, iPad and Android apps

Apple (App Store) or Google (Google Play) sells and bills Pro in the apps, under their own terms. For these purchases:

  • Payment is charged to your Apple ID or Google account when you confirm the purchase.
  • A subscription renews automatically for the same period and price unless you turn off auto-renewal at least 24 hours before the current period ends.
  • The renewal is charged within the 24 hours before the current period ends.
  • You manage and cancel subscriptions in your App Store or Google Play account settings after purchase. In Kindoc, open Profile, then Plan, and choose Manage subscription to go there.
  • If a free trial is offered, any unused part of it ends when you buy a subscription.
  • When you cancel, Pro stays on until the end of the period you paid for. You are not charged again.
  • Refunds for these purchases follow Apple's and Google's rules: ask them.

On the web

On the web, we sell Pro. Our payments provider, RevenueCat, runs the checkout and Stripe processes the payment. For these purchases:

  • You pay when you confirm the purchase.
  • A subscription renews automatically for the same period and price until you cancel it. Cancel before the end of a period to avoid the next charge. Open Profile, then Plan, and choose Manage subscription, or write to us.
  • When you cancel, Pro stays on until the end of the period you paid for.
  • For refunds, write to support@kindochealth.com.

Right of withdrawal (EU and UK, web purchases)

If you live in the European Union or the United Kingdom and buy Pro on the web, you can withdraw from the purchase within 14 days, without giving a reason. The 14 days start on the day of the purchase.

To withdraw, tell us before the 14 days end with a clear statement: an email to support@kindochealth.com is enough, or you can use the model form below. We refund you within 14 days of hearing from you, with the same means of payment, at no cost to you.

Pro is a service that runs for as long as your plan lasts. If you asked us at checkout to start Pro straight away, within the 14 days, and you then withdraw, you pay for the Pro you had until you told us: we refund the price less an amount in proportion to that time. If you did not ask for Pro to start straight away, we refund the full price.

The lifetime plan is the same Pro service, with no end date, so the same right of withdrawal applies to it. For the time you had it, we charge the yearly plan's daily rate: the price of the yearly Pro plan on the web when you bought, divided by 365, for each day until you told us. We refund the rest of the price.

If you live in the United Kingdom, you also have the rights that UK law on subscription contracts gives you, including any notices and cancellation periods it requires.

For App Store and Google Play purchases, refunds and withdrawals go through Apple's and Google's own processes: ask them.

Changes and cancellation

  • If a price changes, we or the store tell you before the new price applies, and you can cancel before it does.
  • Deleting the app or your account does not cancel a subscription. Cancel it in the store or account where you bought it.

12. Using Kindoc fairly

In general

You agree not to:

  • Use Kindoc for anything illegal, or in a way that infringes other people's rights.
  • Try to get around the limits, the one-device rule or our security.
  • Copy, decompile or reverse engineer Kindoc, except where the law allows it.
  • Resell, rent or redistribute Kindoc, scrape it, or use it to build a competing service.
  • Overload Kindoc, or use bots or scripts to send messages.

With the care team

You agree not to:

  • Share another person's health information without the right to (section 9), or pretend to be someone else.
  • Rely on Kindoc in an emergency, or leave someone who may be in danger without calling for help (section 4).
  • Present a reply or a visit summary as the work of a doctor or another professional, or as a medical record, a certificate or a prescription.
  • Try to make the team claim to be human or a professional, or to give doses, prescriptions or instructions for self-harm, or to break its rules in any other way.
  • Use the team to harm, harass or deceive anyone, or for sexual or romantic chat.
  • Insult, threaten or abuse the team, or send it content meant to break it.

What you may not upload

  • Illegal content.
  • Sexual content.
  • Photos of intimate parts of a child's body. For a child, describe the problem in words and show a doctor.
  • Photos of intimate parts of an adult's body, unless the photo shows your own body and your health question needs it.
  • Photos or documents about another person, unless you may share them (section 9).
  • Malware, or anything meant to harm Kindoc or its users.

You can report a reply that is wrong, unsafe or offensive from the reply itself. We read reported replies to check them and improve the team's answers.

We may remove content or suspend an account that breaks these rules. We may report illegal content to the authorities.

13. Your content

"Your content" means what you type and upload (messages, photos and documents), what you enter about yourself and the people you add, and the replies, summaries, notes and health record entries made for you.

When you upload a photo or a document, you promise that you took it or may use it, and that you may share what it shows about anyone in it (section 9).

Your content stays yours. You give us a licence to store, process and show it, and to send it to the providers named in our privacy policy, only to provide Kindoc to you. This licence ends when you delete the content or your account. We do not use your content to train AI models.

14. Intellectual property

Ours

Kindoc, its name and logo, its design, its characters (their names, portraits and personalities), its pictures, texts and software belong to us or our licensors. We give you a personal, limited, non-exclusive, non-transferable right to use Kindoc under these terms. We can take this right back if you break them.

Yours

You may keep, print and share your replies and visit summaries for your own care and the care of the people you add, for example with your doctor.

Copyright complaints

If you believe something in Kindoc infringes your copyright, write to support@kindochealth.com or to Morlans, San Sebastián, Spain. Include: your contact details; the work you believe is infringed; where the content is in Kindoc; a statement that you believe in good faith that the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you own the right or may act for its owner; and your physical or electronic signature. We may remove the content and tell the person who uploaded it, who can send a counter-notice to the same address.

15. Other services and links

Kindoc links to services we do not run, such as the App Store, Google Play, the sign-in pages of Apple and Google, and the websites of help lines. Their own terms and privacy policies apply to them, and we are not responsible for them. When you share a visit summary, it leaves Kindoc, and whoever receives it handles it under their own rules.

16. Availability, changes and ending the agreement

  • We may change, add or remove features, characters or limits, or limit or stop Kindoc. If we remove something you pay for, we tell you first.
  • Kindoc needs an internet connection, and it depends on AI models that other companies run. It can be slow or unavailable. Your mobile operator's data charges are yours.
  • You can stop using Kindoc and delete your account at any time. See the account deletion page.
  • We may suspend or close your account if you break these terms, if the law requires it, or if we stop offering Kindoc. If we close your account without a breach on your part, we tell you first when we can, and refund any prepaid period we billed directly.
  • The parts of these terms that by their nature should last, such as those on health decisions, intellectual property, liability and governing law, stay in force after the agreement ends.

17. No warranties

We provide Kindoc "as is" and "as available". We work to keep it running, safe and correct, but we do not promise that it will always be available, free of errors or secure, or that its replies, summaries, care levels, help cards or health records will be correct, complete or right for you. As far as the law allows, we give no other warranties, express or implied.

18. Limits of our liability

To the extent the law allows:

  • We are not liable for decisions about your health, or anyone else's, made on the basis of Kindoc, including a decision to get care later or not at all, or for harm from a reply, a summary, a care level, a check-in, a help card or a health record entry.
  • We are not liable for indirect or consequential losses, lost profits or data.
  • Our total liability to you is limited to the amount you paid us for Kindoc in the 12 months before the claim.
  • You will compensate us for claims by others caused by content you uploaded, by health information you shared without the right to, or by your breach of these terms.

Nothing in these terms limits liability that the law does not allow us to limit, such as for death or personal injury caused by negligence, or for fraud. Nothing in these terms takes away rights you have as a consumer under the law where you live.

19. Following the law

You may not use Kindoc if you are in a country under a comprehensive embargo, or on a government list of people who may not receive services. You are responsible for following the laws that apply where you use Kindoc.

20. Governing law and disputes

These terms are governed by the laws of Spain. Disputes go to the courts of Spain.

If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can also bring a claim in its courts. We would like to hear from you first: most problems are solved with an email.

21. Changes to these terms

We may update these terms. The date at the top shows the latest version. If a change matters to you, we tell you in the app or by email before it applies. If you keep using Kindoc after that, the new terms apply. If you do not accept them, stop using Kindoc and cancel any subscription.

22. General

  • If a court finds part of these terms invalid, the rest stays in force.
  • You may not transfer your rights under these terms to anyone else. We may transfer ours to a company that takes over Kindoc, without reducing your rights.
  • If we do not enforce a right at once, we do not give it up.
  • These terms and the privacy policy are the whole agreement between you and us about Kindoc. If you got Kindoc from the App Store or Google Play, section 23 and that store's own terms also apply, and section 23 wins where it differs from the rest.

23. If you got Kindoc from the App Store or Google Play

App Store

If you downloaded Kindoc from Apple's App Store, these terms also include the following, which win over anything else in them:

  • These terms are between you and us, not Apple. We, not Apple, are responsible for Kindoc and its content.
  • Your right to use Kindoc is limited to Apple-branded devices that you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow, including use by other accounts through Family Sharing where those rules allow it.
  • We alone provide maintenance and support for Kindoc. Apple has no obligation to provide any maintenance or support for it.
  • If Kindoc fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the price you paid for Kindoc, if any. To the extent the law allows, Apple has no other warranty obligation for Kindoc. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are our responsibility, as far as these terms and the law make them so.
  • We, not Apple, are responsible for handling any claims by you or anyone else about Kindoc or your use of it, including product liability claims, claims that Kindoc fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If anyone claims that Kindoc or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not in a country that is subject to a United States Government embargo or that the United States Government has designated as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties.
  • When you use Kindoc, you must also follow the terms of third parties that apply to you, such as your mobile data provider's.
  • Questions, complaints and claims about Kindoc go to us, not Apple: JartaApps, Morlans, San Sebastián, Spain, support@kindochealth.com.
  • Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted it, to enforce these terms against you as a third-party beneficiary.

Google Play

If you downloaded Kindoc or bought Pro on Google Play, Google Play's Terms of Service also apply to the download and the purchase. Google is not a party to these terms and is not responsible for Kindoc.
